Terms of Sale and Website Terms

These terms apply to every quote, order and sale by Cliffside Trading 32 (Pty) Ltd ("Cliffside", "we", "us") and to the use of www.cliffside420.com. By placing an order or accepting a quote you ("the buyer") agree to them. If a signed credit agreement or written contract with you says something different, that agreement applies to the extent of the difference.
1. Who may buy
1.1 We sell only to persons 18 years or older. By ordering, you confirm that you are 18 or older.
1.2 We mainly supply retailers, wholesalers and other trade buyers. We may ask for proof of age, company registration or VAT registration before supplying, and may decline any order.
2. Quotes and orders
2.1 A quote is valid for the period shown on it. After that, prices and availability may change.
2.2 An order is accepted only when we confirm it in writing (including by email or WhatsApp) or when we dispatch the goods.
2.3 We may sell part cases and single units where the quote or website shows them.
2.4 Product pictures are for illustration. Minor differences in colour or packaging do not make goods defective.
3. Prices
3.1 Prices are in South African rand (ZAR) and exclude VAT unless stated otherwise. VAT is added at the applicable rate.
3.2 Delivery charges, where they apply, are shown on the quote or at checkout.
3.3 We may correct obvious pricing errors before we accept an order.
4. Payment
4.1 Payment is by EFT or by card through our payment provider iKhokha.
4.2 Payment must be received in full before dispatch, unless we have approved a credit account for you in writing.
4.3 Credit accounts are payable on the terms agreed in writing. If an account is overdue, we may suspend supply until it is paid.
4.4 Bank details: our banking details appear only on our official quotes and invoices. We will never change them by WhatsApp or email. If you receive a message saying our bank details have changed, do not pay. Call us on 031 880 0550 to confirm. We are not liable for payments made into an account that is not ours because of such a message.
4.5 EFT payments count as received only when the funds clear in our account.
5. Delivery
5.1 We aim to deliver within 1 to 3 working days after payment (or order acceptance on credit) to major South African centres. Other areas may take longer. Delivery times are estimates, not guarantees.
5.2 Delivery is free on orders over R5,000 including VAT. Smaller orders carry the delivery charge shown on the quote or at checkout.
5.3 Please check the goods when they arrive and note any visible damage or shortage on the courier's delivery note.
5.4 Risk in the goods passes to you on delivery to the address you gave us.
6. Ownership
Ownership of the goods stays with Cliffside until we have received payment in full. Until then you hold the goods on our behalf, and we may recover them if payment is not made when due.
7. Returns and defects
7.1 Report any shortage, damage, incorrect item or defect to orders@cliffside420.com or 031 880 0550 within 7 days of delivery, with your order number and photos where possible.
7.2 If we confirm the problem, we will at our choice replace the goods, repair them or refund you. Return of goods needs our prior approval, and goods must be unused and in their original packaging unless they are defective.
7.3 If the Consumer Protection Act 68 of 2008 applies to you, you keep all your rights under that Act, including the right to return defective goods within six months. Nothing in these terms limits those rights.
8. KnockBox equipment warranty
8.1 KnockBox machines and parts supplied by us carry a 90 day warranty from the date of delivery against defects in materials and workmanship.
8.2 The warranty does not cover misuse, accidental damage, incorrect installation or power supply, normal wear and tear, unauthorised repairs or modifications, or loss or theft.
8.3 To claim, contact us with the order number, serial number (if any) and a description or video of the fault. We will repair or replace the item, at our choice.
8.4 Where the Consumer Protection Act applies, its implied warranty of quality applies in addition to this warranty.
9. Lawful use
You are responsible for making sure that your purchase, resale and use of our products complies with all laws that apply to you, including any local rules on sale, display, labelling and age restrictions. You must not resell our products to anyone under 18.
10. Limitation of liability
10.1 To the extent the law allows, we are not liable for any indirect or consequential loss, including loss of profit, business or goodwill, arising from the supply or use of our products or website.
10.2 To the extent the law allows, our total liability for any claim relating to an order is limited to the price paid for the goods in that order.
10.3 Nothing in these terms limits liability that cannot be limited by law, including your rights under the Consumer Protection Act where it applies, or liability for our gross negligence or fraud.
11. Website
11.1 We try to keep the website accurate and available, but we do not guarantee that it is free of errors or always online.
11.2 Content on the website, including text, images and logos, belongs to us or our suppliers and may not be copied for commercial use without our written permission.
11.3 Brand names shown on the website belong to their owners.
12. Personal information
We process personal information in line with POPIA and our Privacy Policy (/privacy), which forms part of these terms.
13. General
13.1 These terms are governed by the law of the Republic of South Africa, and the courts of KwaZulu-Natal have jurisdiction.
13.2 We may update these terms. The version on the website when you place your order applies to that order.
13.3 If any clause is found invalid, the rest of the terms remain in force.
13.4 A failure or delay by us in enforcing any right is not a waiver of that right.
